<meta content="text/html; charset=utf-8" http-equiv="Content-Type"> <meta content="Word.Document" name="ProgId"> <meta content="Microsoft Word 12" name="Generator"> <meta content="Microsoft Word 12" name="Originator"> <link href="file:///C:%5CDOCUME%7E1%5Cmohi%5CLOCALS%7E1%5CTemp%5Cmsohtmlclip1%5C01%5Cclip_filelist.xml" rel="File-List" /> <link href="file:///C:%5CDOCUME%7E1%5Cmohi%5CLOCALS%7E1%5CTemp%5Cmsohtmlclip1%5C01%5Cclip_themedata.thmx" rel="themeData" /> <link href="file:///C:%5CDOCUME%7E1%5Cmohi%5CLOCALS%7E1%5CTemp%5Cmsohtmlclip1%5C01%5Cclip_colorschememapping.xml" rel="colorSchemeMapping" /><style type="text/css">  </style> <p class="MsoNormal"><b style="">Zakaat of wife’s jewelry:<o:p></o:p></b></p> <p class="MsoNormal"><o:p> </o:p></p> <p class="MsoNormal">The Nisab (prescribed limits of wealth) for Zakaat is 60 mg 755 mg of gold or 425 gm 265 mg of silver.<o:p></o:p></p> <p class="MsoNormal"><o:p> </o:p></p> <p class="MsoNormal">When the jewelry is the property of the wife, she is responsible for the Zakaat of the jewelry.<span style="">  </span>Even if the husband is in debt, the outstanding Zakaat of the wife is not waived.<span style="">  </span>Thus, the wife should give the Zakaat with her own money or by taking the money from the husband or through any other way and give it to a needy person who is not a Syed (a descendent of the Holy Prophet (Sallallahu alaihi wa sallam).</p> <p class="MsoNormal"><o:p> </o:p></p> <p class="MsoNormal"><b style="">Zakaat on jewelry apart from gold/silver:</b></p> <p class="MsoNormal"><o:p> </o:p></p> <p class="MsoNormal">In itself, Zakaat is not Wajib on precious stones like gems, etc.<span style="">  </span>However, if these are bought and kept as trading goods, then Zakaat is Wajib on them if they reach the prescribed limit and 1 year passes on them.</p> <p class="MsoNormal"><o:p> <br /> The ruling for Zakaat on clothes is the same.<br /> <br /> </o:p></p> <p class="MsoNormal"><b style="">To whom should Zakaat be given:</b></p> <p class="MsoNormal"><o:p> </o:p></p> <p class="MsoNormal">Zakaat cannot be given to parental relations like grandfather/grandmother and similarly all paternal and maternal relationships and to relations of marriage like son, daughter, grandson, granddaughter and all others below them.<span style="">  </span>Also, a husband and wife cannot give Zakaat to one another.<span style="">  </span>Apart from these all other relatives who are in need of Zakaat, if they are not Saadat i.e. descendants of Prophet Muhammad (Sallallahu alaihi wa sallam) can be given Zakaat.<span style="">  </span>Relatives should be preferred over others while giving Zakaat.<span style="">  </span>Giving Zakaat to relatives has a 2-fold reward, one of giving Zakaat and the other of maintaining good relationships with the relatives. (Sila Rahmi).</p> <p class="MsoNormal"><o:p> </o:p></p> <p class="MsoNormal">It is better (Afdhal) for the person giving the Zakaat to give it first to their brothers, sisters.<span style="">  </span>Then their kids, if they are needy and are not Syed.<span style="">  </span>Then the father’s brother and sister.<span style="">  </span>Then their kids.<span style="">  </span>Then the mother’s brother, sister, then their kids.<span style="">  </span>Then after this, the maternal grandmother’s relatives will be considered deserving.<span style="">  </span>As per the details given, the wife or the husband should give the Zakaat, to their own relatives.</p> <p class="MsoNormal"><o:p> </o:p></p> <p class="MsoNormal"><b style="">Paying Zakaat through money gotten from fixed deposit:</b></p> <p class="MsoNormal"><o:p> </o:p></p> <p class="MsoNormal">One section of scholars holds the opinion that India is Dar Ul Aman i.e. a place of peace.<span style="">  </span>Thus, the dealings with increase/decrease in money come under usury (Sud in Urdu) and the amount got through fixed deposit is Haram (forbidden).<span style="">  </span><o:p></o:p></p> <p class="MsoNormal"><o:p> </o:p></p> <p class="MsoNormal">Another section of scholars holds the opinion that India is a Non-Islamic country and the said dealings don’t come under usury.<span style="">  </span><o:p></o:p></p> <p class="MsoNormal"><o:p> </o:p></p> <p class="MsoNormal">When there is a difference of opinion among the scholars about this, then there is a doubt in the money got through fixed deposit.<span style="">  </span>Zakaat should be given from the money in which there is No. doubt of any kind.<span style="">  </span>Thus, Zakaat should not be given from the money got from fixed deposit.<span style="">  </span></p> <p class="MsoNormal"><o:p> </o:p></p> </meta> </meta> </meta> </meta>
