f:759 -    Funeral bath of stillborn baby

Name : Muhammad Ali
Question:     In our family, a lady gave birth to a stillborn baby.  Some people said that the baby should be given a bath and Salaat Ul Janazah should be offered.  Some people disagreed.  Please tell us the Shariah ruling about this.

Answer:     If the new born baby is stillborn, but the body is completely formed, then Salaat Ul Janazah will not be performed, but because the child is a human being, out of regard, the funeral bath is given.  If the body/organs are not completely formed, then neither will funeral bath be given nor will Salaat Ul Janazah be offered.

As given in Al Bahr Ur Raiq, Vol. 1, Pg No. 330:

Translation: If the new born is stillborn with completely formed body/organs, then Salaat Ul Janazah will not be offered, but out of regard , a funeral bath will be given.  If the body is not completely formed, then neither will funeral bath be given nor will Salaat Ul Janazah be offered.
