f:716 -    Reciting Tashahud at wrong place and moment in Salaat
 Country : Ousa,
Name : Inayath Ali Himmathy
Question:     A certain person was offering a Salaat of 4 Raka?at.  He sat down in Qaida in the 3rd Raka?at and realized this after he had recited the Tashahud.  Will he have to perform Sajda Sahw for this?

Answer:     It is Obligatory (Fardh) to stand up for the 4th Raka’at after the 2nd prostration of the 3rd Raka’at.  If someone sits after the 2nd prostration instead of standing, then he/she should stand up, complete the Salaat and perform the prostration of forgetfulness (Sajda Sahw), as standing is an article of Salaat and delay in it makes this prostration Compulsory (Wajib).  As is mentioned in Fatawa A’alamgiri, Kitab Us Salaat.
