f:536 -    What if not able to perform Sae'e

Question:     In Haj, if somebody cannot perform the Sae?e after the Tawaf Ziyarah (the welcome Tawaf) till the dusk of 12 Dhil Hijjah, then because of not performing that, is it necessary to perform Dam?

Answer:     Among the conditions of the Sae’e is that the Sae’e should be performed after the Tawaf.  Also, it is a Sunnah after finishing the Tawaf, 2 raka’at should be offered and immediately after it the Sae’e should be started, according to this Hadith of Sahih Bukhari Vol 1:

Translation: Hadhrat Ibn e Juraij (May Allah be well pleased with him) narrates on the authority of Hadhrat ‘Amr bin Dinar (May Allah  be well pleased with him), that he heard Hadhrat Abdullah bin ‘Umar (May Allah  be well pleased with him) that when the Holy Prophet (Sallallahu alaihi wa sallam) graced Mecca with His presence, then He (Sallallahu alaihi wa sallam) performed the Tawaf, offered a Salaat of 2 raka'at of Tawaf and then performed the Sae’e between the Safa and Marwah.  After narrating this, Hadhrat Abdullah bin ‘Umar (May Allah be well pleased with him) recited the verse of the Holy Quran of Surah Ahzaab.

In the light of this Hadith, it has been declared a Sunnah to perform the Sae’e immediately after the Tawaf and the 2 raka'at of the Tawaf.  If after the Tawaf, for the sake of rest or for any other reason, the Sae'e is performed after taking a break, there is no problem in it.  If without any reason, an extraordinarily delay is made, then it is Undesirable (Makruh) and bad, but any expiation or atonement is not compulsory.  

As has been mentioned in Radd ul Muhtaar Vol 2, The Book of Haj, pg no. 185… and in Manasik Haj by Mulla ali Qari.

If, for some reason, anybody could not perform the Sae’e after the Tawaf till the dusk of 12 Dhil Hijjah, then he/she should perform the Sae’e after this and if the Sae’e could not be performed till the dusk of 12 Dhil Hijjah, even then they should perform Sae’e.  Nevertheless, expiation or atonement is not necessary.  However, unnecessary and extreme delay is Undesirable (Makruh).
