f:479 -    What to do if the Mehr is not decided at the time of marriage

Question:     Assalamalaikum Wa Rahmatullahi Wa Barakutuhu

My friend was married 6 years ago.  At the time of his marriage, all brothers were leaving jointly and my friend also had a job.  My friend does not know what the Mehr is.  His brothers had given some 2, 3 tolas of gold, but my friend is not sure whether it was as Mehr or not?  He wants to give cash.  Can he do so?

Answer:     Walaikum As Salaam Wa Rahmatullahi Wa Barakutuhu

If at the time of the marriage of your friend, the dower (Mehr) was decided as 20 or 30 grams of gold and his brother/s had paid it on his behalf, then as per the Shariah, his dower is paid.

However, if the brother/s had only given it as a gift, then if the dower was decided as some amount of gold, then giving that decided amount of gold is necessary.

If however, the amount of dower was not decided at all, then your friend will have to give the customary dower (Mehr Mithl ).  This means the dower, which is usual is the family of the bride's father of those women who are similar to the present bride in age, physical beauty, honesty, manners, child-bearing, etc.  If the dower of the ladies of the bride's father's family cannot be ascertained or they are not similar to the present bride, then the dower of any lady who is similar to the present bride in the qualities mentioned above.
