f:461 -    Waiving loan with the intention of giving Zakaat

Name : Muhammad Imtiyaz
Question:     I have given a loan to a certain person.  He is so poor that he cannot pay the loan back.  Can I waive his loan with the intention of Zakaat?

Answer:     It is not valid if the lender wants to waive the loan of the borrower by making an intention (Niyyah) of Zakaat.  However, the lender can give the amount to the borrower and have him return it.  As given in Durre Mukhtaar, Vol. 2, Pg. No. 13 and on the same page of Radd Ul Muhtaar.

Thus, instead of waiving the loan with the intention of giving your Zakaat, what you can do is give him the amount and have him return it to you.
