f:313 -    Haraam currency and Halal currency

Question:     If money earned through unlawful means is mixed with money earned through lawful means, then the whole money becomes unlawful.  Is it not?  This is what is happening in ATM services and banks.  Please answer this question in light of Fiqh Hanafi.

Answer:     As per the Hanafi School of jurisprudence, grains and other material things are specified for the individual, but currency notes, coins, etc. are not.  Thus, if money earned through unlawful means and money earned through lawful means are mixed, then the amount of money which is unlawful will be considered unlawful and the amount which is lawful, will remain lawful.  

In light of this, in ATMs, etc. when lawful and unlawful money is mixed, the lawful amount does not become unlawful.

As given by 'Allama Ibn Nujaim Misri (May Allah shower His mercy on him) in Al Bahr Ur Raaiq, Sharh Kanz Ud Daqaaiq, Kitab Ul Bu'yoo Fi Fasli Ahkami Ba'yil Fasid.
