f:1173 -    Is marriage without witnesses valid?

Question:     My question is that whether a Nikah is valid without witnesses and without the sermon of marriage.  If the girl and boy are both amenable and no one else is accepting of this match, then what should be done?  We don’t want our identities to be revealed.

Answer:     In the Shariah, a marriage is solemnized in the presence of 2 male witnesses or 1 male and 2 female witnesses.  Without this, the marriage is not valid at all.  However the sermon of the marriage is a Sunnah.  As a safeguard against future troubles, it is necessary that marriage be registered with the Qazi as well.

Even though adult guys and girls can marry out of their own free will, if they end up marrying somebody not suitable and compatible with them (out of their Kufu), then the parents or the nearest guardian has the right to get the marriage annulled.

Marrying with the permission and express wish of the parents has many blessings in it.
