f:91 -    Nikah through phone or internet
Country : Hyderabad, India,
Name : Oqaab

Question:
I want to know in the light of the Shariah, whether Nikah through the phone or Internet is correct or not.

.....................................................................................................................................
Answer:
In the light of the Holy Quran and the Hadith, the Jurists have ruled that offer and acceptance of the Nikah should happen only in one assembly.  Thus, if the groom and the bride offer and accept directly through the phone or Internet, the Nikah will not be done at all.

Thus, the person who is not present should make a person who is present as his/her representative through the phone or Internet and if that person performs the offer and acceptance with the bride or groom as a representative, then the Nikah will be established as the offer and/or acceptance of the representative is considered as the offer/acceptance of the person being represented.

As given in Fatawa A’alamgiri, Vol. 1, Pg. No. 269.

And Allah (Subhanahu Wa Ta’ala) knows best.
