f:416 - What to do with Qadianis places of worship

Question: Sometimes, in remote villages Qadiani people make their base in an area and start their places of worship. Later on, when people become aware of their real intentions, they drive them out of the area. Their worship places remain vacant and there is a danger that the Qadianis might again make a hold there. Should they be destroyed? Should they be converted into Masjid and Salaat should be offered there? How should be they used? May Allah Ta?ala increase your knowledge and piety.

Answer:
If the place where the Qadiani worshipped was a Masjid, then obviously, because of their occupation, it does not cease to be a Masjid anymore. It will remain a Masjid still, as given in Durre Mukhtaar, Kitab Ul Waqf.
If it was a Muslim’s property whom they had misguided, then it will remain the property of the Muslim. Giving it to them was itself wrong. Now, the Muslim can himself make it into an endowment for Masjid. Thus, a Masjid can be made in that premises. As given in Durre Mukhtaar, Kitab ul Waqf.
If it was the property of the Qadianis themselves, then with their being out of the fold of Islam, this property does not cease to be theirs. Muslims do not have the right to make a Masjid in that premises, as the Shariah does not permit making a Masjid on someone else’s land. However, if that premises is bought from them, then it can be made into a Masjid. Muslims can buy that from the Qadianis and turn into a Masjid.
If their places of worship are vacant and not in anyone’s occupation, then taking it as “Masjid Ziraar,” in an Islamic rule, the ruler can get it demolished. As it is given in Tafseer Nasafi, Surah Tauba, verse 107.
As per the above mentioned cases, it can be made into a Masjid.
