f:1138 -    Laughing while offering Salaat

Question:     I was offering Salaat with a person and that person suddenly laughed during the Salaat.  I heard his laugh quite clearly when I was in prostration.  Did his laugh invalidate his Salaat and Wudhu?  When I informed him that his Salaat was invalidated, he told me that the scholars have abrogated this rule.  Please answer this question in light of Hadith.
Answer:     As per the Hanafi School of Islamic Jurisprudence, if someone guffaws while in Salaat, then that person’s Salaat and ablution (Wudhu) are both invalidated and re-offering them is Compulsory.  There is a Hadith in Sunan Daraqutni in this regard:

Translation: Hadhrat Abu Hurairah (May Allah be well pleased with him) relates from the Holy Prophet (Sallallahu alaihi wa sallam) that the Holy Prophet (Sallallahu alaihi wa sallam) said:  When someone guffaws, then ablution and Salaat should both be re-performed.  (Sunan Daraqutni, Hadith No. 621)

As far as abrogation of this command is concerned, it should be remembered that the scholars have no authority to abrogate any command of the Holy Quran or the Hadith.  A command of the Holy Quran or Hadith can be abrogated by a verse of the Holy Quran or a Hadith only.  The scholars merely describe the same rules.

That ablution and Salaat are both invalidated is as per the Hanafi School of Jurisprudence.  As per the other schools of jurisprudence, only Salaat is invalidated and the ablution is not invalidated.  Other Imams have proofs that support their position.  As mentioned in Mausoo’a Fiqhiyya Al Kuwaitiyya.
