f:277 -    Eating Mynah - Allowed or not
Country : India,
Name : Muhammad Afzal Khan
Question:     Mufti Sahab, my question is that what does the Shariah say about Mynah?  It is allowed to eat it?  What about its egg.  Please reply as soon as possible.

............................................................................
Answer:     Everything in its essence is permissible, as long as there is no proof about its prohibition.  The Shariah has given the details about all that is prohibited.  Everything excepting them are Halal and permissible.  The animals which the Holy Prophet (Sallallahu alaihi wa sallam) has prohibited are forbidden, as given in Sahih Muslim:

Translation:  It has been narrated on the authority of Hadhrat 'Abdullah bin 'Abbas (May Allah be well pleased with them) that the Holy Prophet (Sallallahu alaihi wa sallam) has prohibited against every animal which is carnivorous and every bird which has claws.  (Sahih Muslim, Vol. 2, Pg No. 147, Hadith No: 3574)

In the light of the Hadith, the Fuqaha (Islamic Law Experts) have said that the birds, which peck at grain and do not hurt with their claws nor attack are permissible and the birds, which attack with their claws and hurt are Haraam (forbidden).

Mynah does not attack with its claws, it pecks.  Thus, a Mynah is Halal and its egg is also permissible.

And Allah (Subhanahu Wa Ta'ala) knows best.
